Take 2 Medical PLLC, DBA: Optimize HP and its parent companies, subsidiaries, affiliates, successors, and assigns (the “Company,” “Optimize,” “we,” or “us”) owns and operates websites (the “Websites”) located at optimize-hp.com(the “Platform”). Your access and use of the Platform, any part thereof, or anything associated therewith, including its content (“Content”), and any products or services provided through the Platform or otherwise by Optimize, and any affiliated website, software, or application owned or operated by Optimize (collectively, including the Platform and the Content, the “Service”) are subject to this Privacy Policy. Capitalized terms not otherwise defined in this Privacy Policy have the same meaning as set forth in our Terms and Conditions.
We are committed to respecting the privacy of users of the Service. We created this Privacy Policy (“Privacy Policy”) to tell you how Optimize collects, uses, and discloses information in order to provide you with the Service. By enrolling in our membership, completing any onboarding or intake process, or otherwise accessing or using the Service, you acknowledge the most recent version of this Privacy Policy. We will update this Privacy Policy when necessary to reflect material changes in the Service or how we use personal information, and as required by applicable law. If we make any changes to our Privacy Policy, we will post the revised Privacy Policy and update the “Last updated” date at the top of the Privacy Policy. If we make material changes to this Privacy Policy, we will provide notice or obtain consent regarding such changes as may be required by law. If you are using the Service on behalf of an individual other than yourself, you represent that you are authorized by such individual to act on that individual’s behalf and that such individual acknowledges the practices and policies outlined in this Privacy Policy.
Adult-only Notice. Our Service is intended only for adults 18 years or older. We do not knowingly collect personal data from anyone under 18. If a parent or guardian believes we have collected information from a minor without consent, please contact us so we can delete that data.
Protected Information.When you enroll in an Optimize membership or are otherwise onboarded into the Service, you are establishing a direct customer relationship with Optimize that enables you to access and/or utilize the various functions of the Platform and the Service as a user. As part of that relationship, you provide information to Optimize, including, but not limited to, your name, email address, shipping address, phone number, and certain transactional information, which we do not consider to be “protected health information” or “medical information.” However, in using certain components of the Service, you may provide certain health or medical information that may be protected under applicable laws. Optimize is not a “covered entity” under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), and its related regulations. One or more of the Labs, Pharmacies or Medical Groups (as defined in our Terms and Conditions) may or may not be a “covered entity” or “business associate” under HIPAA, and Optimize may in some cases be a “business associate” of a Pharmacy or Medical Group. It is important to note that HIPAA does not necessarily apply to an entity or person simply because there is health information involved, and HIPAA may not apply to your transactions or communications with Optimize, the Medical Groups, the Providers, the Labs, or the Pharmacies. To the extent Optimize is deemed a “business associate” solely in its role as a business associate, Optimize may be subject to certain provisions of HIPAA with respect to “protected health information” (“PHI”) that you provide to Optimize or the Medical Groups. In addition, any medical or health information that you provide that is subject to specific protections under applicable state laws (collectively, with PHI, “Protected Information”), will be used and disclosed only in accordance with such applicable laws. However, any information that does not constitute Protected Information under applicable laws may be used or disclosed in any manner permitted under this Privacy Policy. Protected Information does not include information that has been de-identified in accordance with applicable laws. The Medical Groups and Providers have adopted a Notice of Privacy Practices that describes how they use and disclose Protected Information. By accessing or using any part of the Service, you acknowledge receipt of the Notice of Privacy Practices from your Medical Group and Provider(s).
By accessing or using any part of the Service, you understand that any information that you submit to Optimize that is not intended and used solely for the provision of diagnosis and treatment by the Medical Group and Providers, laboratory services by the Labs or prescription fulfillment by the Pharmacies, is not considered Protected Information, and will be subject only to our Privacy Policy and any applicable state laws that govern the privacy and security of such information. For clarity, information you provide to Optimize in connection with enrolling in a membership, completing onboarding or intake processes, or otherwise being granted access to the Platform, including name, date of birth, username, email address, shipping address, and phone number, are not considered Protected Information.
Collection of Personal Information. The personal information we collect depends on how you interact with us, the services you use, and the choices you make. We collect information about you from different sources and in various ways when you use our services, including information you provide directly, information collected automatically, information from third-party data sources, and data we infer or generate from other data.
- Information you provide directly. We collect personal information you provide to us. For example, we may collect your name, email address, phone number, and billing and physical addresses. We may also collect demographic data such as your gender, date of birth, and zip code. We may receive information from third-party websites or social networks if you connect your profile on those sites to our Service (for example, via Facebook, Twitter, Instagram). We may collect payment information, such as your credit card number and other payment details. We may collect Content and files that you upload to the Service, including photographs, videos, documents, or email messages and other communications you send to us.
- Sensitive personal information.We may collect certain categories of sensitive personal information. This may include government-issued identifiers such as driver’s license, passport number, and Social Security number. We may collect account access information like usernames, account numbers, passwords, security or access codes. We may collect sensitive demographic data about your race or ethnic origin. We may collect the contents of communications that you make via the Service. We or our service providers may use biometric information (such as a fingerprint or facial recognition data) to verify your identity. We also collect health-related information, including information concerning your medical history, current health status, and medications. This may include data concerning your browsing or usage patterns on the Service.
- Information collected automatically. When you use the Service, we (or our service providers) may automatically collect device and usage information through cookies, web beacons, and other tracking technologies. This information can include your Internet Protocol (IP) address, browser and device type, operating system, mobile device identifier (such as IDFA or Android ID), time zone, unique device identifiers, language preferences, and pages viewed. We may collect information about how you interact with the Platform, such as pages or content you view, search queries you make, and features you use. We may collect log information (such as access times, errors, and performance data) and location information (such as your IP geolocation) from your device. We may also collect analytics and usage data via cookies and similar technologies, which help us analyze usage patterns and administer and improve the Service. If you block or disable cookies or other tracking technologies, some features of the Service may not function properly.
- Information from other sources. We may obtain information about you from third-party sources, such as identity verification services, advertising networks, analytics providers, and publicly available sources. We may combine this information with other information we collect to improve our Service, to protect against fraud, or as otherwise described in this Privacy Policy.
We use the information we collect in various ways to provide, maintain, and improve our Services. This includes: to facilitate the creation of and secure your account; to provide customer support; to communicate with you about products, services, or promotions; to personalize and improve the Services; to process transactions and send related information; to detect, prevent, or respond to fraud, abuse, security or technical issues; to comply with legal obligations. We may combine information about you that we have with information we obtain from other sources to better provide our Services and respond to your requests.
We also may share information as follows:
- Service Providers. We share information with our vendors and service providers that help us operate our Service (e.g. hosting, data storage, analytics, payment processing).

- Business Transfers. If Optimize is acquired by or merges with another entity, we may share your information with the acquirer.
- Aggregate or De-identified Data. We may share aggregated or de-identified information that does not identify any individual.

Data Retention and Security. We retain your personal information for as long as necessary to provide the Service to you and as otherwise needed to comply with legal obligations, resolve disputes, enforce our agreements, and as described in this Privacy Policy. We employ administrative, technical, and physical security measures designed to protect your information, but we cannot guarantee absolute security. No method of transmission or storage is fully secure, and you acknowledge this limitation.
10DLC Regulations. With regards to our SMS texting campaigns, we want to clarify that we do not share consumer information collected through these campaigns with any third parties for marketing purposes, including 10DLC campaigns. Specifically, we do not share or sell any information with third parties, including, but not limited to the following:
- Opt-In consent data
- Mobile numbers
- Personal information data
We are committed to complying with all applicable regulations, including the 10DLC regulations, and ensuring the privacy and security of your information.
Your Rights. Depending on your jurisdiction, you may have certain rights regarding your personal information. This may include rights to access, correct, or delete your personal information, and rights to obtain an accounting of disclosures. If you reside in a jurisdiction with privacy or data protection laws, you may have additional rights under those laws. Jurisdictional Issues. The Service may only be used within Texas within the United States as described in our Terms and Conditions. Accordingly, this Privacy Policy, and our collection, use, and disclosure of information about you, is governed by U.S. law.
Changes to Privacy Policy.If we make material changes to this Privacy Policy, we will update the “Last updated” date and post the revised policy. If we believe material changes may impact your privacy rights, we will provide reasonable notice (e.g., via email or a notice on our Website).
